Terms of Service

These Terms of Service govern the access and use of TradeFundrr’s Sites and Services. LLC, a Delaware Limited Liability Company, and its affiliate entities (“TradeFundrr.com”, “we”, “our”, or “us”), as well as our account holders and users (you”, “your”, and “User”), may access the Sites and Services, including all content, functionality and products, information about products and services offered, your accounts and other tools. The Privacy Policy, which is incorporated by reference herein, defines all capitalized terms that are not defined elsewhere.

TradeFundrr.com’s Sites and Services will only be provided to you if you accept all Terms without any modification. These Terms become legally binding between you and TradeFundrr.com when accepted. You represent that if you accept these Terms for an entity you have the legal authority necessary to bind it.

Please read these terms carefully. BY REGISTERING FOR, ACCESSING, BROWSING, CREATING AN ACCOUNT, POSTING OR DOWNLOADING CONTENT, OR OTHERWISE USING THE TradeFundrr.com SITES OR SERVICES OR ENTERING INTO ANY OTHER AGREEMENT WITH US, YOU ACKNOWLEDGE (ON BEHALF OF YOURSELF AND ANY ENTITY YOU REPRESENT) THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, DO NOT ACCESS, BROWSE, OR OTHERWISE USE THE TradeFundrr.com PRODUCTS AND CONTENT. ADDITIONALLY, BY REGISTERING FOR, ACCESSING, BROWSING, CREATING AN ACCOUNT, POSTING OR DOWNLOADING CONTENT, OR OTHERWISE USING THE TradeFundrr.com SITES OR SERVICES OR ENTERING INTO ANY OTHER AGREEMENT WITH US, YOU ACKNOWLEDGE AND AGREE TO GIVE UP, AND YOU HEREBY WAIVE, ANY RIGHTS TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR REPRESENTATIVE ACTION concerning ANY DISPUTES OR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE OR THE SERVICES.

These Terms are effective once accepted until they are terminated in accordance with the terms. Please review these Terms of Use and the Privacy Policy periodically, as we reserve our right to change or modify them after giving you notice. This notice can take any form we choose, including, but not limited to, clear and obvious messaging or postings on the Sites or Service that indicate the Terms of Usage have been changed. Any change or modification will be effective immediately upon notice.  In our sole discretion, we may suspend or terminate the use or access of TradeFundrr.com Products or Content for anyone who violates this Agreement.

You are not allowed to interfere with or abuse the TradeFundrr.com Products and Content or any other system resources, services, or networks that are connected or accessible via the TradeFundrr.com Products and Content. TradeFundrr.com Products & Content may only be used for legal purposes. It is prohibited to use TradeFundrr.com Products & Content in a way that violates or contradicts these Terms of Usage.

TradeFundrr.com uses English as its official language. Translations are provided for reference and convenience only. In the event of a conflict, the English version will prevail.

DEFINITIONS

“Account” refers to a User’s registered account with TradeFundrr.com, providing access to specified Services or functionality on TradeFundrr.com’s Sites.

“Content” encompasses all information and materials found on the Sites, including Services, TradeFundrr.com’s Products and Content, text, images, photos, trading ideas, publications, opinions, rumors, advice, charts, financial information, ratings, and reviews.

“Credit or Debit Card Information” includes credit card or debit details, such as card number, CVV number, expiration date, phone number, name, billing address, and email address.

“Data” denotes information generated by Users, including all information related to trading activity, whether aggregated or otherwise.

“Designated Agent” refers to the TradeFundrr.com representative assigned to receive notifications of claimed infringement under the Digital Millennium Copyright Act.

“Fee” represents the regular payment for utilizing the activated Account.

“Feedback” stands for comments, feedback, information, or other materials provided by Users regarding the Sites and Services.

“Force Majeure Event” includes any act or event beyond reasonable control, such as strikes, civil commotion, pandemic, government orders, invasion, terrorist attack, war, fire, explosion, storm, flood, earthquake, epidemic, or other natural disaster.

“Intellectual Property” encompasses TradeFundrr.com’s Sites and Services, their contents, or any copyright, trademark, trade name, service mark, or other proprietary information of TradeFundrr.com.

“Linked Website” refers to any third-party-owned website linked to or from TradeFundrr.com’s Site.

“Marks” collectively represent trademarks, service marks, slogans, logos, trade dress, and other identifiers displayed on TradeFundrr.com’s Sites and Services.

“Orders” are requests for subscriptions or other services placed through the Sites or Services or a third party.

“Personal Data” comprises information relating to an identified or identifiable natural person or any information used for the behavior profiling of a particular natural person.

“Services” include the TradeFundrr.com Evaluations or other services offered by an applicable affiliate of TradeFundrr.com.

“Simulated Account” is an account using real-time simulated Data and any accounts related to tracking education courses provided by TradeFundrr.com. Trades in a simulated account do not incur actual profits or losses.

“Sites” encompass TradeFundrr.com’s Websites, software, applications, online services, and products.

“Soft Breach” occurs when the daily loss limit objective for your Account is breached, resulting in a temporary trading suspension for the remainder of the current trading session.

“System” denotes the integrated cloud computing solution for providing TradeFundrr.com Services.

“Terms” refer to the terms and conditions outlined in these Terms of Use, including operating rules, policies, and procedures published on the Sites or Services.

“Third Party Services” denote products or services not under the control of or maintained by TradeFundrr.com.

“TradeFundrr.com Evaluations” signify a simulated account used for experiential learning, where a User develops trading skills with performance evaluated for funding opportunities with the trading capital of TradeFundrr.com or advancement to another product or service offered by TradeFundrr.com.

“TradeFundrr.com Parties” include TradeFundrr.com, its parents, subsidiaries, affiliates, related companies, suppliers, licensors, partners, and the officers, directors, employees, agents, and representatives of each.

“TradeFundrr.com Products and Content” include the Website, Services, System, Content, and all other content, services, and/or products available on or through the Sites.

“User Content” refers to blogs, comments, or other content submitted or posted by a User intended for public display on any of TradeFundrr.com’s Sites or Services.

“User Credentials” represent the unique email/username and password combination.

“User Section” is the user interface located on the Website.

“Website” refers to the compilation of all web documents made available via the domains www.TradeFundrr.com

Services

The TradeFundrr.com evaluation is a Simulated account where your performance will be assessed to determine if you are eligible to receive funding from the trading capital provided by TradeFundrr.com. You may also advance to another TradeFundrr.com product or service.

By completing an appropriate order or registration form, you can order Services via the Website. We will send you an email with your login information for the User Section and Account. This will allow you to access any applicable Sites and Services.

The scope of the Services may vary depending on your Account (e.g. by the analytical tools you have access to). You must provide us with complete, accurate, and current Data. This includes any data you submit to us via registration, Account, or other means. Any change to your Data, or updating the Data on your Account must be notified immediately. TradeFundrr.com does not have to verify any Data. You acknowledge that the provisions of these Terms and applicable laws that give rights to consumers do not apply if you include an identification number, a tax registration number, or similar information on the order or registration form, in your Account details or if a legal entity is stated.

The TradeFundrr.com evaluation fee varies depending on the options selected. It also depends on the parameters and buying power that are required to meet the TradeFundrr.com evaluation’s conditions and goals. The fee is determined by the options you choose when completing the TradeFundrr.com evaluation order form. You pay the fee to gain access to TradeFundrr.com and all educational resources or services provided. The fee is not refundable if, for instance, you cancel your account or request cancellation via email, if the Services are terminated prematurely (for instance, you do not complete the TradeFundrr.com Evaluation), if the TradeFundrr.com Evaluation conditions aren’t met, or if the Terms have been violated in any way.

TradeFundrr.com reserves the right to refuse or stop any services if you make an unjustified complaint or dispute the payment with your bank, payment service, or chargeback service.

You can check, correct, and amend any Data you enter in the registration form until the order is binding. By submitting your registration, you can order the Services that you want. TradeFundrr.com confirms receipt of your order via email. The order for the TradeFundrr.com Evaluation is complete upon payment of the fee.

You acknowledge that to use our services, you will need the necessary technical equipment and third-party software. The Website can be accessed by the most popular web browsers. You are responsible for the cost of Internet access, equipment, and web browser updates. TradeFundrr.com cannot guarantee or warrant that the Services are compatible with specific software or equipment.

You acknowledge that TradeFundrr.com is not the operator of any trading platform. Their terms and conditions, as well as their privacy policies, will apply to their products and services. You are required to read the terms and conditions, privacy policies, and any other requirements before engaging in any Services.

We reserve the right, to deter and stop any gambling-type behavior, and to suspend all future orders placed by you for the Services if we identify that the unusual behavior is related to the User’s involvement in Prohibited Conduct (see the section on Prohibited Conduct). We reserve the right, if we determine that the unusual behavior is related to the User’s participation in Prohibited Conduct, (see the Prohibited Conduct Section), to determine the nature of this behavior and the reasonable consequences. This may include, but not be limited to, immediate termination of access to Sites and Services. TradeFundrr.com is committed to educating Users and honing their skills to develop healthy trading practices. TradeFundrr.com strives to create a safe environment where Users can engage in Simulated trading. It reserves the right, at its discretion, to take any actions it deems necessary to discourage any User from engaging in gambling or any other behavior that conflicts with TradeFundrr.com’s mission and values.

A written electronic communication via e-mail, or the User Section, is also considered a written communication.

Eligibility

You represent and warrant you are 18 years old. You represent and warrant, in jurisdictions, territory, or locations, that you are at least 18 years old. You may not use the Sites or Services if you are younger than the minimum age in your jurisdiction or territory for using the Sites or Services. This applies regardless of whether or not your parent or guardian has consented to you using the Sites or Services.

You represent and warrant you have never been convicted of any felony or disciplined either by the National Futures Association or the U.S. Commodity Futures Trading Commission. You represent and warrant that there is no outstanding balance at a trading company. You are not allowed to use our Sites or Services if you have been convicted of a crime, disciplined by the National Futures Association or the U.S. Commodity Futures Trading Commission or if you have a balance outstanding with a broker.

It is your sole responsibility to ensure that these Terms comply with all applicable laws, rules and regulations. If these Terms or the use of the Sites or Services violate any law, rule or regulation, the right to access or use the Sites or Services will be revoked. The Sites and Services are only available for your personal use. They are not offered for any other party’s benefit or use.

You may not use or enter into this agreement if you reside in a jurisdiction that restricts your ability to enter agreements, such as those outlined in these Terms of Usage. You may also not use or enter into this agreement if you reside in a jurisdiction that prohibits participation in activities or services offered by TradeFundrr.com Products and Content (such as Sites and Services). You are stating explicitly that by using TradeFundrr.com Products and Content you have checked in your jurisdiction if the TradeFundrr.com Products and Content can be used. You acknowledge that we do not represent that the TradeFundrr.com Products and Content is appropriate or available in all places. Those who access TradeFundrr.com Products and Content are doing so at their own risk and on their initiative. They are also responsible for complying with local laws if and where applicable. We reserve the right to limit access to the TradeFundrr.com Content and Products, materials, or other products described or offered on the site to any person, geographical area, or jurisdiction, as we see fit, at any time.

Without our written consent, you may not access TradeFundrr.com products and content (a) if it is for production purposes; (b) if your company is a competitor to TradeFundrr.com; (c) unless monitoring the performance or functionality of TradeFundrr.com sites or services, or (d), for benchmarking purposes or other competitive purposes.

NOT A BROKER-DEALER

You acknowledge and accept that we are not broker-dealers, as that term is used by the United States Financial Services Regulations. We do not offer financial advice directly to you or anyone else as part of the Sites or Services. You agree and acknowledge that we will not be liable for any loss or gain that you may incur as a result of your reliance on information provided by the Sites, Services, or other Users.

RELIANCE ON INFORMATION SHOWN ON OUR SITES OR SERVICES

Financial and market data is included in the information that appears on or via Sites or Services. This information is only provided for general information and entertainment purposes. This information is not verified and we do not guarantee their accuracy, completeness, or timeliness. You are solely responsible for any reliance placed on this information. We do not encourage anyone to act on the information that we provide. We disclaim any liability or responsibility for any reliance that you or anyone else may place on these materials, whether they are from our Sites or services or from someone who is informed of their contents.

The information provided has been compiled without consideration of individual financial circumstances, investment goals, or means. This information is not meant to be investment advice, and they do not take into account your specific financial situation. The investments that are described on or via our Sites or Services come with significant risks. Any discussion of risk contained on or through the Sites or Services shouldn’t be viewed as a comprehensive discussion of those risks. The Sites or Services could be unavailable or inoperable at any time for a variety of reasons, including but not limited to (a), equipment malfunctions; (b), periodic maintenance procedures or repair which we may perform from time to time; or (c), causes outside the control or foreseeable by TradeFundrr.com.

Content from third parties may be found on our Sites and Services. This includes materials that are provided by users, business owners, bloggers, and licensors. All articles, responses to questions, and other content other than that provided by us are the sole opinions of the individual or entity who provides those materials. These materials are not our opinions and we have not verified them. We are not obligated to update the information contained in these publications, which may be outdated. We will not be held responsible or liable for any content or accuracy in any materials that are provided by third parties, whether they appear on the Sites or the Services or elsewhere.

Links to third-party sites or resources on our Sites or Services are only provided as a convenience. Links in banner ads and sponsored links are included. We accept no liability for the loss or damage resulting from using these sites or resources. You access third-party websites linked to our Sites and Services at your own risk. You should read the privacy policies of each website, service, application, or other product you use.

We do not accept any responsibility or liability for User Content. We are not required to screen or monitor any User Content. We reserve the right to remove or edit User Content, in its entirety or part, at our sole discretion, without prior notice, upon notification from a third party.

The Sites and Services are not, and may not be considered, investment services. TradeFundrr.com DOES NOT GIVE OR PROVIDE TO YOU ANY GUIDANCE, INSTRUCTIONS, OR INFORMATION ABOUT HOW OR IN WHICH MANNER YOU SHOULD PERFORM TRANSACTIONS WHEN USING THE SITES, SERVICES, OR OTHERWISE, OR ANY OTHER SIMILAR INFORMATION ABOUT THE INVESTMENT TOOLS TRADED, NOR DOES TRADEFUNDRR.COM ACCEPT ANY SUCH GUIDANCE, INSTRUCTIONS, OR INFORMATION FROM YOU. The Sites and Services include access to tools for simulated exchange trading or trading with other instruments on other financial markets, the provision of analytical tools, training and educational materials, and other ancillary services. Financial market information is used in the simulated trading; however, you acknowledge that any trading that you perform through the Services is not real. You also acknowledge that the funds provided to you for Simulated Trading are fictitious and that you have no right to possess those fictitious funds beyond the scope of their use within the Sites and Services, and in particular that they may not be used for any actual trading and that you are not entitled to the payment of those funds. Unless expressly agreed otherwise, you will not be paid any remuneration or profits based on the results of your fictitious trading, nor will you be required to pay any losses.

REFUND POLICY

Due to the nature of the service, we do not provide refunds except in the case where fraudulent activity is involved. In the case of a visitor who may infringe or repeatedly, infringe our copyrights or other intellectual property rights or the rights of others, we may, at our own discretion, terminate or deny access to and use of the Website and/or products. In the case of such termination, we will have no obligation to provide a refund of any amounts previously paid.

If for any reason you are dissatisfied with your purchase, please allow us to resolve the issue by sending an email to help [at] Tradefundrr.com Please include the words “Dissatisfied Purchase” in the subject of the email and we will promptly attempt to resolve the matter in your favor.

USER

You may not combine or transfer your Account’s performance or service parameters or Data with other products or Users, except as explicitly contemplated by advancing beyond the TradeFundrr.com Evaluation.

Login Data protects access to your Account and Services. It is prohibited to share or make available these login Data to any third parties. The Sites and Services can be used by your employees and representatives if you have registered as a company. The User is liable for any and all actions performed via the User’s account. TradeFundrr.com is not responsible for the misuse of the Sites and Services by the user, and TradeFundrr.com is not responsible for the negative consequences of such misuse.

The User acknowledges the fact that the Sites and Services are not guaranteed and may be unavailable due to maintenance or upgrades. TradeFundrr.com is in particular not responsible for any unavailability or damage to Data or any other content uploaded, transferred, or saved by the User on the Sites and Service. The User has no right to compensation for this.

Contact Support to terminate your account at any time. TradeFundrr.com confirms receipt of the User’s request by email. The contractual relationship between TradeFundrr.com and the User will terminate as of the date of the confirmation email. The User will not be entitled to a refund for any fees and costs. All fees and costs are final and non-refundable.

Users are allowed to simulate trading on TradeFundrr.com Evaluation, except for any transactions that violate Prohibited Conduct. (See below for a definition of this term). You agree to adhere to good trading practices and market standards (e.g. risk management rules) on the financial markets. You may be restricted by the trading conditions you select. TradeFundrr.com may have access to the information regarding the transactions that you make on the Sites. TradeFundrr.com has the right to use and share any Data related to your activities on the Site and Services with its affiliates. You agree that TradeFundrr.com may perform these activities automatically, without your consent, consultation, or approval, and you will not be entitled to any compensation or revenue associated with TradeFundrr.com’s use of Data. TradeFundrr.com is not responsible for the accuracy or completeness of the market data displayed by your Account, nor any interruption, delay, or inaccuracy. While using the Sites and Services, you agree to adhere to market-standard risk management rules when trading on financial markets. You acknowledge that you are not meeting these standards if your trades have a significantly larger or smaller number of positions or a larger or smaller position size compared to other trades.

TradeFundrr.com has the right, at its discretion, to decide whether certain practices, strategies, or situations constitute Prohibited Conduct.

TradeFundrr.com can cancel your Services immediately and terminate your Account if you violate any Prohibited Conduct. TradeFundrr.com can prevent the User from accessing all Sites or Services, such as the Account or the Sites without compensation or refunds if the User engages in any Prohibited Behavior. TradeFundrr.com will not be responsible for any trading or investment activities you perform or that are related to the Services, in relation to real trading on the financial market. This is except when expressly agreed to pursuant to a separate or supplemental written agreement.

The financial markets are subject to rapid and frequent changes. Trading on financial markets may not be profitable and can lead to significant financial losses. The user’s previous performance and profits are not a guarantee or indication of future results.

TradeFundrr.com Evaluation

The User will receive their login data via email after paying the fee. Your access will be suspended if you don’t activate the TradeFundrr.com Evaluation within 30 calendar days from the date it was made accessible to you. Within six months after the initial suspension, you can renew your access by contacting Support or the User Section. Otherwise, we will stop providing the Services and there is no right to refund the fee. To graduate from TradeFundrr.com Evaluation a user must meet all profit goals while following the applicable Trading Rules (defined under the Prohibited Conduct section) as well as the account parameters that apply to the User’s account for the TradeFundrr.com Evaluation. These Trading Rules and account parameter changes may occur at any time without prior notice.

The TradeFundrr.com Evaluation is deemed unsuccessful if the User fails to meet the conditions outlined in the paragraphs above. If the User wants to continue Simulated Trading they will need to create a new Simulated Account using the current rates.

You will have the option to either get funded using the trading capital provided by TradeFundrr.com or to advance to another service or product offered by TradeFundrr.com. This decision is at the sole discretion of TradeFundrr.com. Both options are governed under a separate written agreement.

Third-Party Services

Third-party services may be mentioned on our Sites or Services. The Terms do not cover Third Party Services. We encourage you to review the terms and conditions of each website, service, application, or other product you use or interact with, including Third Party Services. It is your responsibility to perform due diligence on any Third Party Services and determine whether they are suitable for you. You agree that TradeFundrr.com will not be responsible for any harm, damages, or negative experiences you may have when accessing or utilizing such Third Party Services. You do so at your own risk if you visit or use Third Party Services that are referred to in our Sites and Services.

Disclaimer of Warranties

TradeFundrr.com EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, concerning THE TRADEFUNDRR.COM PRODUCTS AND CONTENT INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TradeFundrr.com DOES NOT WARRANT OR REPRESENT THAT THE FUNCTIONS OR OPERATIONS OF TradeFundrr.com SITES OR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT TradeFundrr.com SITES OR SERVICES, ITS SERVERS, OR ANY E-MAIL SENT FROM TradeFundrr.com ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liabilities

TradeFundrr.com and its parent companies, subsidiaries, affiliates or partners or their respective employees, agents, officers, and directors will not be responsible for any indirect, incidental, or special damages (including lost profits, data loss or corruption, or lost opportunities), nor for any monetary or property damages. This applies to any claim by a third party arising from or related to access, use, or content of our Sites or Services or linked websites, or in reliance on any tool, functionality or other content made available through the Sites The above limitation may not be applicable to you because some states/jurisdictions don’t allow for the exclusion of or limitation of liability in relation to consequential or incidental damage. In these jurisdictions, we will limit our liability to the extent allowed by law. You can only stop using the Sites if you’re not satisfied with the Sites, Services, or any of their terms.

TradeFundrr.com retains the right at any time to change, remove, or add any of the elements and functions on the Sites and/or Service without compensation. TradeFundrr.com will not be held responsible for any failures to provide Sites or Services due to technical and operational issues beyond its control. This includes, but is not limited to, Force Majeure Events, or when TradeFundrr.com cannot fulfill obligations due to law or public authority.

TradeFundrr.com is not responsible for any products, services, applications or other third-party content that you use in connection with the sites or services.

No liability will be accepted by TradeFundrr.com for any loss or damage arising from or connected to these terms, the performance or violation thereof, any product or service, the use or performance of which, or any claims arising therefrom, if any, in any way. Our liability shall not exceed (a) The amount you paid TradeFundrr.com for its products or services in the month immediately preceding, or (b), $100. The above limitation may not be applicable to you because some states/jurisdictions don’t allow for the exclusion of or limitation of liability in relation to consequential or incidental damage. In these jurisdictions, we will limit our liability to the maximum permitted by law.

This limitation of liability includes the transmission of viruses that infect your equipment, failures on communication lines, telephones, or other interconnections, unauthorized access, theft, operational errors, or any force majeure.

PURCHASES; CREDIT CARD AND OTHER FINANCIAL INFORMATION

Certain TradeFundrr.com sites allow Users to place orders. You will pay TradeFundrr.com for the order price shown on the “Order Summary Page” or other ordering mechanisms. TradeFundrr.com and its affiliates and service providers may use the services of third-party payment processors to process credit card payments and other accepted payment methods. Any additional terms and/or conditions imposed on your purchase by these third-party payment processors apply. Your chosen payment method will be charged the purchase price, and any fees or taxes applicable upon submission of your order.

Upon purchasing an Order or any other service provided by TradeFundrr.com via the Sites or the Services, you agree that TradeFundrr.com is responsible for providing the requested service. You are not entitled to a refund if you do not use or participate in the purchased service.

Prices and availability are subject to change at any time without prior notice. TradeFundrr.com will correct errors when they are discovered. They also reserve the right to cancel any stated offers and correct any inaccuracies or omissions. This includes after an order has been placed, whether or not it has been confirmed, and regardless of whether your payment method has been accepted and charged. TradeFundrr.com may issue you a credit if your payment method was accepted and charged. This will be done within a reasonable period of time following the revocation of your order.

All taxes are included in the service charges. According to applicable law, tax obligations are the responsibility of users in relation to our services.

TradeFundrr.com accepts credit and debit cards through its Sites or Services and uses the services of third-party payment processors for processing payments. Please see our Privacy Policies for more information. Certain Credit Card and Debit Card Information is encrypted and will be received via a secured page. You represent and warrant to TradeFundrr.com that you have the authority to sign for any credit card, debit card, or other payment method that you provide. This includes paying taxes or fees related to purchases made through our Sites.

You will be subject to the terms and conditions of that third-party site if you are directed there to make a purchase. You do this at your discretion and risk if you wish to provide Credit or Debit Card Information or Personal Data to any third-party service provider or Linked Website. Before providing any information, we strongly recommend that you read the privacy policies and terms of service for third parties. TradeFundrr.com will not be held responsible if you give such information to a third party.

RESTRICTED SITES AND PASSWORDS/USER REGISTRATION

Certain functionalities of the Sites and Services are only available to users who have created an account for the relevant service. These Users will receive unique User Credentials for their account. You warrant and represent that all information about your Account is true and accurate. You represent and warrant you provided a valid e-mail address when registering. You agree that any information you provide, whether to register on our Sites, Services, or in other ways, such as through the use of interactive features of our Sites, Services, or otherwise, will be governed by our privacy policy, and consent to our actions concerning information provided to us consistent with this policy. You can update your data through our Sites and Services, or by contacting the company via the information above.

Users are responsible for maintaining the confidentiality of their User Credentials. They will also be liable for any access or use by them or anyone else using those User Credentials, whether or not that access was authorized. You agree to limit access to your Account to the user who subscribed to it. You agree to notify TradeFundrr.com immediately if you suspect or learn about any unauthorized account usage.

TradeFundrr.com reserves the right to deny access to your account or to block transactions made using your account without notice if it believes that someone other than the registered user is using your account.

TradeFundrr.com has the right to deny User Credentials for any reason. This includes if a User is impersonating someone else, is protected under trademark law or other proprietary rights laws, or is vulgar and offensive. TradeFundrr.com is not responsible for any damage or loss caused by a User who fails to comply with the provisions of this section.

SUBMITTING CONTENT OR COMMENTS ON OUR SITES (CONTENT PROVIDED BY YOU)

By submitting User Content, You agree to these Terms.

You may not post User Content that is illegal, indecent, or profane, or that threatens, defames, derogates, violates TradeFundrr.com’s Privacy Policy or harms TradeFundrr.com, any third party, constitutes advertising or commercial solicitation (except when pre-approved by TradeFundrr.com in writing), or consists primarily in an unsolicited mass electronic mailing.

The User Content must not be offensive or harassing towards any individual. You cannot submit any materials which are, or appear to be, Personal Data of others. This includes full names, postal addresses, email addresses, telephone numbers, or other attributes that would constitute a privacy invasion. The User Content must not be offensive, obscene or objectionable. It should also not be deceptive or fraudulent.

TradeFundrr.com cannot guarantee that User Content will remain private even if it is entered in a password-protected section of the Sites or Services. You should not submit User Content you wish to keep private. You are responsible for all User Content that you upload, transmit, or otherwise provide via the Sites or services. You provide all User Content at your own risk. We cannot guarantee that the User Content you provide will not be viewed or accessed by unauthorized persons. You acknowledge that copies of the User Content you provided, even after its removal, may still be viewable on cached or archived pages, and may have been stored or copied by Internet archives or other Users or Visitors. As applicable and in its sole discretion, we may make User Content publicly available to other Sites and Services users and visitors.

The User Content must not contain software viruses, worms, spyware, trojan horses, or any other computer code, files, or programs designed to disrupt, impair, or destroy computer software, hardware, or telecommunications devices, or limit their functionality.

The User Content must not violate in any way the copyrights, trademarks, or other intellectual property rights of anyone or any entity. It also cannot contain any confidential, proprietary, or trade secret information or information that could be used to violate any legal rights in any jurisdiction.

It is against the law to impersonate another individual or entity or to mislead anyone or any entity about your origin.

You agree to disclose all financial relationships, including ownership interests, business, employment, and other financial relationships, you may have with any financial instrument or company named in User Content. You agree to not submit User Content to increase or reduce the price of a financial product and then sell or buy that financial product because of this increase or decrease. You must include in any User Content you submit about a stock or financial instruments that you intend to buy or sell within 72 hours.

You may not submit any User Content that violates local, state, or national law. This includes but is not limited to the regulations of the U.S. Securities and Exchange Commission and U.S. Commodity Futures Trading Commission, other securities laws and rules of any stock exchange. You agree that User Content won’t be used to commit illegal acts, cause civil liability, or violate any rights, including intellectual property, contractual, privacy, or personal rights.

Content License

By submitting User Content, you grant TradeFundrr.com a non-exclusive worldwide right and license (“License”) in any format or form, in full or in part, that is unrestricted and irrevocable. This License allows TradeFundrr.com to use, reproduce distribute, display, and publish User Content and any other website, channel, or distribution platform, for any reason, without any obligation or notification to you. TradeFundrr.com also reserves the right to sublicense or authorize others TradeFundrr.com is granted all rights, licenses, and privileges described herein immediately upon the submission of User Content and will continue forever and indefinitely. You should not submit any information you want to keep private with User Content.

By submitting User Content, you also represent and warrant that:

• You are entitled to submit User Content, and you grant the License described herein.

• You will not need to obtain any additional licenses, royalties, or permissions from third parties to use your User Content as described herein;

• The User Content is not a violation of any third-party rights, such as intellectual property or privacy rights.

The User Content is compliant with the Terms and applicable laws.

INTELLECTUAL PROPERTY, TRADEMARKS, AND COPYRIGHTS

TradeFundrr.com’s Sites and Services, their features and functionality, including all information, software and text, displays, videos, and images, as well as the design and selection of these materials, are owned by TradeFundrr.com or its licensors. They are also protected by United States copyright laws, trademark laws, patent laws, trade secrets, and other proprietary or intellectual rights laws. TradeFundrr.com Sites and Services, or any component thereof, are owned by TradeFundrr.com or its licensors. They are protected under United States and international copyright laws as well as trademarks, patents, trade secrets, or other intellectual property or proprietary rights laws.

You are granted the right to use, access, display, and navigate our Sites and Services for personal, noncommercial, and nonpublic use. Except for personal, noncommercial, and nonpublic use, you may not reproduce, distribute, or modify our materials, nor create derivative works, display them publicly, perform them publicly, republish them, download, store, or transmit them. You may not use any part of the Sites or Services for commercial purposes.

You must return or destroy all copies you made if you violate these Terms by printing, copying, modifying, downloading, or providing anyone else with access to our Sites and Services. TradeFundrr.com reserves all rights, including title and interest, in our Sites, Services, or any content found on our Sites and services, that are not explicitly granted to you. All rights reserved.

If you use our Sites and Services in a way that is not explicitly permitted by these Terms, then it may be a violation of these Terms, as well as a violation of copyright, trademarks, trade secrets, and other laws.

TradeFundrr.com owns the Marks that appear on our Sites and Services unless stated otherwise. All rights not explicitly granted are reserved. ALL RIGHTS ARE RESERVED. It is prohibited to use, remove, or alter any Marks in any way, whether it be on other materials, presentations, domain names, meta-tags, or for any other purpose without our written consent.

TradeFundrr.com reserves the right to refuse permission for any use of Intellectual Property on its Sites and Services, including the Content. This includes reproduction, alteration, removal, transmission, publication, or distribution, whether by electronic, mechanical, photocopying, recording, or other means. TradeFundrr.com’s trademarks may not be used as metatags in any third-party website. It is not permitted to co-brand or frame our Sites (or display any of the content via in-line hyperlinks) without TradeFundrr.com’s prior written consent. TradeFundrr.com will work with you to stop any co-branding or framing that is unauthorized. Any copyright, trademark, or patent notice on any of our products cannot be removed, modified, or altered. You agree to refrain from taking any actions that may interfere with our rights, titles, or interests in our Intellectual Property.

DIGITAL MILLENNIUM COPYRIGHT ACT

• Please provide us with information that will allow us to reach you. This includes your address, phone number, and, if you have one, email address.

• A statement that you believe in good faith that the use of the material as complained about is not authorized by either the copyright owner or its agent;

• A statement under penalty of perjury that the complainant is authorized to act for the owner of the exclusive right that has been allegedly violated.

Termination

The user can cancel their subscription to any free service publication at any time. They simply need to send TradeFundrr.com an email asking them to remove themselves from the distribution list. Each email containing a free service publication will contain a link that allows a user to unsubscribe. You can unsubscribe by clicking the link in the email..

TradeFundrr.com has the right, at any time and at its discretion, to refuse or terminate your access to any TradeFundrr.com sites or services. This termination can be due to a violation of Terms, other agreements, unauthorized reproduction or use of publications or information, or for any reason at TradeFundrr.com’s discretion. You agree that if such access is denied or terminated you will not try to create a new account under any name. All provisions in these Terms will survive termination. This includes ownership provisions, disclaimers of warranties, indemnities, and liability limitations.

Jurisdiction and Enforceability

Please read this entire section carefully. EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, IT REQUIRES MANDATORY ALTERNATIVE DISPUTE RESOLUTION PROCESSES INSTEAD OF LITIGATION AND AFFECTS LEGAL RIGHTS YOU MAY OTHERWISE HAVE. The Terms will be governed and construed by the laws of New York State and the United States of America without regard to conflict of law principles. In connection with any legal action that arises out of, or is related to, these Terms or the subject matter, you irrevocably consent to the exclusive jurisdiction of courts located in New York City, State of New York USA. You waive all objections based on the lack of personal jurisdiction or improper venue in any action.

Arbitration in New York, New York will be used to resolve any dispute, claim, or controversy that arises out of or is related to this Agreement, its breach, termination or enforcement, interpretation or validity, as well as the determination of scope or applicability to arbitrate. JAMS will administer the arbitration in accordance with its Comprehensive Arbitration Rules & Procedures, and according to the expedited procedures in these Rules. The award may be judged by any court with jurisdiction. The cost of arbitration will be equally shared by the parties. This clause does not prevent the Parties from seeking interim remedies from a court with appropriate jurisdiction in support of arbitration. TradeFundrr.com is entitled to all costs, including reasonable attorney’s fees, if litigation or arbitration relating to the subject of this Agreement occurs. The parties agree:

No arbitration proceeding under this agreement, whether it is a dispute between a consumer or business, will be certified or conducted as a group action, nor shall claims be brought on behalf of other Users or potential Users, or similar persons.

No arbitration proceeding shall be consolidated or combined in any manner with another arbitration proceeding. The parties agree to arbitrate a consumer dispute or business dispute on an individual basis and each waives the right to participate in a class action.

Force Majeure

Force Majeure Events will not make us liable or responsible in the event of a failure or delay to perform any of our obligations. Force Majeure Events will suspend our obligations under these Terms and extend the time to perform them.

Violation of These Terms

If the User or Visitor violates any provision of these Terms, including by accessing the Services in conflict with this Agreement, providing incomplete, untrue, or non-updated information, acting in a manner that (A) may cause TradeFundrr.com risk of damage to its reputation, (B) violates trading rules, TradeFundrr.com can prevent your access to all sites and/or services, without prior notice, and without compensation.

WAIVER OF CLASS ACTION RIGHTS

Please read this entire section carefully. A CLASS ACTION OR JURY TRIAL IS NOT PERMITTED IF THE LAW IS APPLICABLE.

THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY CLAIMS AGAINST THE OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF LAW TO BE AGAINST PUBLIC POLICY. TO THE EXTENT EITHER PARTY IS PERMITTED BY LAW OR COURT OF LAW TO PROCEED WITH A CLASS OR REPRESENTATIVE ACTION AGAINST THE OTHER, THE PARTIES AGREE THAT: (A) THE PREVAILING PARTY SHALL NOT BE ENTITLED TO RECOVER ATTORNEYS’ FEES OR COSTS ASSOCIATED WITH PURSUING THE CLASS OR REPRESENTATIVE ACTION (NOTWITHSTANDING ANY OTHER PROVISION IN THIS AGREEMENT); AND (B) THE PARTY WHO INITIATES OR PARTICIPATES AS A MEMBER OF THE CLASS WILL NOT SUBMIT A CLAIM OR OTHERWISE PARTICIPATE IN ANY RECOVERY SECURED THROUGH THE CLASS OR REPRESENTATIVE ACTION.

EACH PARTY HEREBY WAIVES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING DIRECTLY OR INDIRECTLY ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE TRANSACTIONS CONTEMPLATED HEREBY (WHETHER BASED ON CONTRACT, TORT OR ANY OTHER THEORY). EACH PARTY HERETO (A) CERTIFIES THAT NO REPRESENTATIVE, AGENT, OR ATTORNEY OF ANY OTHER PARTY HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SUCH OTHER PARTY WOULD NOT, IN THE EVENT OF LITIGATION, SEEK TO ENFORCE THE FOREGOING WAIVER AND (B) ACKNOWLEDGES THAT IT AND THE OTHER PARTIES HERETO HAVE BEEN INDUCED TO ENTER INTO THIS AGREEMENT BY, AMONG OTHER THINGS, THE MUTUAL WAIVERS AND CERTIFICATIONS IN THIS SECTION.

INDEMNIFICATION

You agree to indemnify and defend the TradeFundrr.com parties for all costs, liability, and legal fees arising from or relating (a) to your access or use of our sites or services, (b) to your violation of these Terms or applicable laws, (c), to the infringement of intellectual property rights or other rights of a person or entity by you or by anyone using your account and (d) to any funding or payment method used in your account. TradeFundrr.com has the right to take over the defense and control of any claim for which we are required to indemnify you. You agree to assist us in our defense. You agree to not settle any matter without TradeFundrr.com’s prior written consent. TradeFundrr.com makes every effort to inform you as soon as it becomes aware of such a claim, action, or proceeding.

PROHIBITED CONDUCT

The TradeFundrr.com Evaluation requires that the market function as it would in a real-world environment. It is forbidden to use the simulated environment to gain an advantage during the TradeFundrr.com evaluation. You are not allowed to exploit slippage, a preferential order, market gaps, or a large volume of trades in a short period of time in the TradeFundrr.com Evaluation. A violation of these Terms occurs when trading activity is undertaken in the TradeFundrr.com Evaluation in a way that circumvents rules and targets or produces profits that are not possible in live market trading. 

TradeFundrr.com reserves the right, in such an event, to reject any claims that you have passed or advanced in the TradeFundrr.com Assessment, and also render your account ineligible, as well as prohibiting further use of TradeFundrr.com’s Site or Service. You will not be able to withdraw funds from any account with TradeFundrr.com if you are found to be profiting from the simulated environment in order to gain an advantage in your TradeFundrr.com Assessment at any point after you have passed the TradeFundrr.com evaluation.

The following are prohibited by the Site and Services:

• Trading strategies that are designed to exploit or cause errors on the Services (such as incorrect prices displayed or delayed updates) will not be tolerated.
• Using any trading strategies that include disruptive practices (as determined at TradeFundrr.com’s sole discretion), such as but not limited to spoofing.
• Trading a large number of contracts or a high volume in a day.
• Perform trades at any time, even if the bid or offer is not the best.
• Perform trades with an external or slow data feed.
• Performing trades alone or with others, including accounts connected or those held by different TradeFundrr.com parties, or combinations thereof, with the intent to manipulate, abuse, or give the User an unfair edge while using the Site and Services. For example, engaging in short-term or high-frequency trading or entering opposite positions simultaneously.
• Trades that are in conflict with TradeFundrr.com’s User Section Terms and Conditions and TradeFundrr.com’s Evaluation Terms and Conditions.
• Use of any software, artificial Intelligence, ultra-high speeds, or mass data entry that could manipulate, abuse, or give the User an unfair edge, while using the site or services.
• Other than that, the User may not perform trades that conflict with the way trading is performed on applicable markets or that could cause TradeFundrr.com to suffer financial or any other harm.
• To pool or hedge the risk of unconnected aggregate accounts, you can work with others to perform the same strategy, the opposite strategy, or any other activity. This includes working together with unconnected account holders.
• Use of any instrument that could adversely affect Site and Services, or would be intended for misuse of any errors, bugs, or other deficiencies on the Sites and Services.
• Avoiding geographic restrictions or other technical restrictions.
• Positioning yourself within 2% or less of the product’s locking limit.
• Trading on behalf of others includes but is not limited to, sharing incentives as part of any business arrangement.
• Other conduct that, at the sole discretion, of TradeFundrr.com deems uncommercial, a game of the market, or otherwise not a viable strategy for trading.

TradeFundrr.com may change the Trading Rules at any time. On the Site, you can find the current Trading Rules. The User agrees to be solely responsible for keeping up to date with Trading Rules. These are subject to change without prior notice at any time.

If not stated otherwise, products may be traded at normal electronic trading times. Trading is only permitted during the normal trading hours of electronic trading unless we indicate otherwise. On TradeFundrr.com, you can find a list of abbreviated holiday hours. TradeFundrr.com only allows traders to trade products that are approved by the company. Please visit our Help Center for more information.

TradeFundrr.com will review any excessive or unrealistic profits or trades made in a single day for possible violations of the Terms and Trading Rules, or any prohibited conduct or uses.

TradeFundrr.com reserves the right to remove Simulated Account Profits, delete an entire trading day, reset a user’s Account, or ban them from using the Site and Services. TradeFundrr.com may, at its discretion, delete a trading day, and all profits or reset an Account if it determines that the activity is Prohibited Conduct. TradeFundrr.com can also ban the User’s access to all or part of the Sites and Services.

OTHER PROHIBITED USES

You are responsible for all acts and omissions under your TradeFundrr.com account. In addition, you agree to refrain from any unacceptable use of Sites, Services, or User Content.

• It is illegal to post, store, or distribute any uninvited or unauthorized advertising or promotional materials, junk mail, spam, chain letters, or other fraudulent schemes or solicitations;
• Use of any software, device, or process, whether manual or automated, to “crawl”, “spider”, or otherwise “search” web pages on the Sites or Services.
• Using TradeFundrr.com or Sites or Services for competitive intelligence to compete against TradeFundrr.com or affiliates.
• The collection of information, such as email addresses or any other contact information, about other users.

REWARDS 

TradeFundrr.com, to encourage healthier trading habits and the use of TradeFundrr.com’s educational materials from time to time, may offer certain prizes, incentives, or rewards (each “Reward”, and collectively “Rewards”) A Reward will not require any additional or specific fees. Each Reward may be offered periodically with specific goals, rules or metrics, payment or delivery terms, expiration dates, and other conditions. 

The user is responsible for keeping track of each Reward, and their eligibility to achieve such Reward. Every Reward that has an expiration will be automatically void or have no effect when its expiration date is reached. Rewards are not transferable and personal to each User. The redemption of any Reward is final, and it cannot be refunded for any reason. A User may only earn a Reward once per Account. TradeFundrr.com is not responsible for letting a user know that a reward has been earned.

To be eligible for earning Rewards, a user must: (i) have a Funded Account, or TradeFundrr.com evaluation, that hasn’t been opened or purchased with any rewards or credits offered by TradeFundrr.com, or its Affiliates. This includes any Rewards; and (ii), be a U.S. Citizen or legal U.S. Resident 18 years of age or older, and not be listed on OFAC Specially Designated Nationals or Blocked Person

TradeFundrr.com reserves the right to prohibit any User or Potential User from participating in a Reward if at its sole discretion (i) that person acts in a disruptive manner, (ii), disparages TradeFundrr.com and its products or services, TradeFundrr.com affiliates or other parties affiliated with TradeFundrr.com; (iii), disparages TradeFundrr.com competitors or their product or service, TradeFundrr.com affiliates TradeFundrr.com can, without notice and for no compensation, cancel or alter any Reward that a User has earned if TradeFundrr.com believes the User violated its Terms. This applies whether or not such activity had anything to do with earning this Reward. TradeFundrr.com makes all decisions regarding Rewards at its discretion.

OTHER IMPORTANT TERMS

The Terms and Conditions are in addition to all other agreements you may have with TradeFundrr.com.

These Terms do not create, nor are they deemed to, a partnership, an agency, a trust arrangement, a fiduciary relation, or if you prefer unless expressly stated otherwise.  

Neither TradeFundrr.com nor you shall have the right, power, or authority to act on behalf of either party, whether expressly or implicitly.

You acknowledge that a breach of these terms would result in irreparable damage and significant injury to TradeFundrr.com. This would be difficult to determine and would not be compensated by damages alone. You agree that TradeFundrr.com is entitled to enforce these Terms through injunctions (without the necessity of posting a bond), specific performances, or other equitable remedies without prejudice to other rights and remedies TradeFundrr.com might have for your violation of these terms.

We reserve the rights to modify, suspend, or discontinue, at our discretion, our Sites, Services, or any service or content, feature, or product offered via our Sites, Services, and to charge fees for the use of these Sites, Services and to modify or waive any fees associated with them. You agree that you and any third parties will not be held liable for any modification to, suspension of, or discontinuance to our Sites, Services, or any service, content, or feature offered through our Sites, Services, or Services.

Each paragraph of these Terms is independent. The remaining paragraphs remain valid even if a court or other authority rules that one of them is illegal or unenforceable.

The Terms are the entire agreement between you and TradeFundrr.com. They supersede any prior verbal or written agreements relating to the subject of the Terms.

If any provision is invalid or unenforceable, it will be replaced with a provision that is as similar as possible to its invalid meaning. The validity of other provisions is not affected by the invalidity or ineffectiveness of one provision. The Terms do not apply to any past or future practices established between the Parties, nor any customs maintained in general, or in the Industry, relating to the Subject Matter of the Performance. They also do not imply rights or obligations for the Parties.

We will not waive our rights if we fail to enforce our rights or delay to do so. You will still be required to perform your obligations. We will only waive your default in writing and will not automatically waive any subsequent default.

TradeFundrr.com can assign any claim arising from these Terms, or any agreement without your consent. TradeFundrr.com is authorized to assign its rights and obligations arising from these Terms, any agreement, or portions thereof, to a third party. You are not allowed to assign or transfer your rights and obligations under these Terms, or any agreement or part thereof.

We may terminate this Agreement at any time, without notice. You may also be denied access to our Sites and Services if you do not comply with these Terms. All obligations and liabilities incurred by the parties before termination will survive termination.

ACCEPTANCE OF AND MODIFICATIONS TO THESE TERMS

We assume all Users and Visitors will have read and understood the Terms and are in agreement with their content. You agree that by using or accessing the Sites and Services, accepting the Terms and Conditions, or entering into an agreement with us on your behalf and for any entity you represent, you have read and understood the Terms. You must not use our Sites and Services if you don’t agree with the Terms.

You acknowledge that you’ve carefully considered the risks associated with the Terms, and you accept them.

The Terms are subject to change. We will inform you of any changes to our Terms and update the revision date. You acknowledge that we may also use clear and obvious messaging on the Sites and Services to let you know the Terms have been modified. You must stop using the Sites and Services if you don’t agree with any changes made to the Terms.S OF THIS AGREEMENT. Subject to any exceptions set forth herein, Participant hereby agrees that any dispute, controversy, or claim arising out of or relating to the TradeFundrr program, the Enrollment Agreement, or T&C (collectively, the “Dispute”) shall be submitted to mandatory final and binding arbitration before the American Arbitration Association in New York City, New York in accordance with its Commercial Arbitration Rules and Mediation Procedures. Notwithstanding the foregoing, Participant waives the right to arbitrate any Dispute as a class action, either as a member or a representative. Class arbitration (including the presiding over any form of a representative or class proceeding) and the consolidation of claims made by more than one plaintiff are both expressly prohibited. Participant hereby agrees to arbitrate any Dispute solely on an individual basis. All legal correspondence should be sent to legal@tradefundrr.com
